GENERAL SALES TERMS AND CONDITIONS

ARTICLE 1: APPLICATION OF GENERAL SALES TERMS AND CONDITIONS

These general sales terms and conditions govern the online sale of Moulin de l’Olivette products. The Moulin de l’Olivette Agricultural Cooperative was set up in 1928 and has its headquarters at Rond-point de l’olivette – 04100 MANOSQUE and is registered with the Registre du Commerce de Manosque under R.C.S number 782 401 780.


ARTICLE 2: ORDER VALIDATION

Orders are accepted when they have been confirmed by payment according to the methods indicated in article 3 of these general sales terms and conditions.
The prices shown and to be paid in cash are in €uros including tax.


ARTICLE 3: PAYMENT

The payment of your order is made when ordering by banker’s card or cheque.

Please contact us for other methods of payment.

Cheques can only be received in €uros drawn on a bank domiciled in France at our headquarters and made out to our company: Moulin de l’olivette – rond-point de l’olivette – 04100  MANOSQUE


ARTICLE 4: SHIPPING

Shipping is carried out by Colissimo Expert La Poste on reception of payment according to the shipping conditions of this company.

Delivery dates:
The usual delivery date is 15 days for Metropolitan France and 25 days for other countries.
However, if 1 month after the indicated delivery date the product has not been delivered, for any other reason except for Act of God, the sale may then be cancelled by the purchaser. On his/her request, he/she can obtain the refund of payment exclusive of all other indemnity. No damages may be requested.
Are considered as Acts of God: war, riot, fire, strikes, accidents.

Damage:
In the case of damage: the purchaser must note his reservations on the shipping document (if he/she wishes to keep the goods) or reject delivery by notifying us by mail, e-mail or fax of delivery damage. Our acknowledgement of receipt of your reservations or rejection grants discharge to the delivery defect ascertained by the purchaser.


ARTICLE 5: RETURN OF NON-CONFORMING GOODS

Conditions:
Any return of product must be subject to a formal agreement between the seller and the purchaser. Any product returned without this agreement will be at the disposal of the purchaser.
All return prices and risks are paid by purchaser.
No returns will be accepted more than 8 days after delivery date.

Consequence:
In the case of an obvious flaw or non-conforming delivered products, duly ascertained by the seller, the purchaser may obtain their replacement.


ARTICLE 6: RIGHT OF RETURN OF GOODS AND REFUND

Under law, the customer has a period of 7 working days from receiving his/her purchase to withdraw. In this case, the return will only be accepted if the order is returned in complete and perfect state in its original packaging. This return is at the expense of the customer. Refund will be carried out in the form of a cheque sent to the customer at least 30 days following reception of the goods.


ARTICLE 7: SHIPPING COSTS

Calculated according to weight, they are shown when your order is validated.


ARTICLE 8: DISPUTES

The general sales terms and conditions and the special conditions of the order are governed by French law.
The parties agree that in the case of disagreement regarding the interpretation or performance of the order, they will strive to reach an out of court agreement.
In the case where an agreement cannot be reached, the dispute will be settled by the tribunal de commerce of Manosque (04100).
